我们注意到，认罪认罚从宽制度在执行过程中，各地还存在一些不同认识，制度效能有待进一步发挥。我们强调，适用认罪认罚从宽制度的案件，要全面审查事实证据，不能因为被告人认罪认罚就降低刑事证明标准。仅有被告人认罪认罚的供述而缺乏其他证据的，依法不能认定有罪。为此，人民法院在促进庭审实质化、加强对认罪认罚自愿性等审查方面，作出了细化规定和裁判指引，进一步保障制度适用的合法性、规范性。
履行网络犯罪防治义务的具体要求，由法律、行政法规或者国家标准的强制性要求作出规定。相关国家标准由国务院公安部门、国家网信部门、国务院标准化行政主管部门会同行业主管部门等制定。
